Terms of Service

These Terms govern the use of services provided by Quantum9. By contracting our services, the client agrees to the conditions below. Read carefully and get in touch if you have any questions.

1. Parties

"Quantum9" is the trademark of Quantum9 Tech LTDA, CNPJ 30.323.500/0001-25, and refers to the company providing software development, design and digital consultancy services. "Client" refers to the natural or legal person who hires the services described in the proposal, contract or service order.

2. Object

These Terms govern the provision of development, maintenance, integration, design and digital consultancy services. The detailed description of services, deliverables, deadlines and prices will be agreed in a specific proposal or contract between the parties.

3. Proposals, scope and changes

Quantum9 will send technical and commercial proposals with a defined scope. Changes in scope requested by the Customer may imply adjustment of deadlines and costs, subject to prior written approval. Work carried out outside the scope will be charged as additional services.

4. Deadline and delivery

The deadlines stated in the proposals are estimates based on available information. Quantum9 will use reasonable efforts to comply, but will not be responsible for delays caused by factors beyond its control, including delays by Customer in approving deliverables or making necessary resources available.

5. Price and payment

Values, deadlines and payment conditions are set out in the proposal or contract. Late payments may be subject to interest charges and correction as provided for in the contract. On hourly projects, hours will be recorded and reported regularly.

6. Intellectual property

Quantum9 retains rights to pre-existing tools, libraries and know-how (background IP). Ownership of deliverables developed specifically for the Customer will be defined in the contract — normally by transfer upon full payment, unless otherwise specified.

7. Confidentiality

The parties agree to keep technical, commercial and strategic information exchanged within the scope of the project confidential, except when required by law or as agreed in writing. Confidentiality obligations survive termination of the contract.

8. Warranty and support

Quantum9 offers a limited warranty for the correction of defects identified in deliverables according to the defined scope. Post-delivery support and ongoing maintenance may be contracted separately. The warranty does not cover changes, misuse or integrations carried out by third parties without prior alignment.

9. Limitation of liability

To the maximum extent permitted by law, Quantum9's liability for direct damages arising from its services will be limited to the total amount paid by the Customer to Quantum9 in the 12 months prior to the event giving rise to the damage. Quantum9 will not be responsible for lost profits, loss of business or indirect damages.

10. Termination

The contract may be terminated by either party upon written notice as provided in the contract. In the event of termination without just cause by the Customer, activities already carried out and costs incurred up to the date of termination will be charged.

11. Protection of personal data

Quantum9 processes personal data in accordance with its Privacy Policy and in compliance with applicable legislation (e.g.: LGPD). Data collected to perform services will be processed for contractual and administrative purposes; Specific instructions on processing and sharing will appear in the contract and in the Privacy Policy.

12. Use of third parties and external services

Solution delivery may involve third-party services (hosting providers, payment gateways, APIs, etc.). Quantum9 selects reliable partners, but does not control external services and is not responsible for the failures or policies of these providers.

13. Digital Products and Quantum9 Webmail

Quantum9 digital products can be purchased by subscription. At Quantum9 Webmail, each box is charged monthly at the price displayed at the time of purchase. The first approved box receives master permission and the contracting officer and master can request additional boxes for the same organization.

The mailbox is activated only after Mercado Pago confirms payment and the domain passes technical validation. Cancellation stops renewal; access remains available through any period already paid for. Overdue payments, refunds, disputes, or use that violates these Terms may result in suspension of the mailbox without automatically deleting stored content.

14. Domain, DNS and customer responsibility

The Customer declares that they have authorization to configure the informed domain. Activation requires proof, sending, and receiving DNS records. MX, SPF, and DKIM changes may affect a previous email service; It is up to the Customer to review conflicts, maintain access to the domain provider and exactly copy the records presented in the guided flow.

Customer is responsible for master users, boxes created, and the accuracy of alternate addresses used for activation and recovery. Credentials, activation links and sessions should not be shared.

15. Acceptable use of email

It is prohibited to use Webmail for spam, phishing, fraud, malware, harassment, violation of rights, sending without legal basis or any illegal activity. Technical limits on messages, recipients and attachments can be applied to protect domain reputation, deliverability and other customers. Serious incidents may result in immediate blockage.

16. Content, continuity and closure

The Customer retains responsibility for the content of its messages and attachments. The operation depends on infrastructure and external providers, and unavailability, DNS delays or delivery failures may occur beyond the reasonable control of Quantum9. Specific SLA only exists when formalized in a specific contract.

Cancellation is not equivalent to a permanent backup. Before access is terminated, the Customer must preserve any information it needs to retain. Retention, deletion and compliance with legal obligations follow the Privacy Policy, the applicable contract and Brazilian legislation.

17. Changes to terms

Quantum9 may revise these Terms from time to time. Changes that affect the Customer's rights will be communicated with reasonable advance notice. The current version will always be available on this page with the last updated date.

18. Applicable law and forum

These Terms will be governed by Brazilian law. Disputes will be dealt with in the competent forum defined in the applicable contract, except when legislation requires a different rule.
